These booking conditions were updated in July 2008. The holidays featured are operated by Mud Hut Travel Ltd (the Company) which is registered in England under company number 06638008. The following conditions, together with our general information and the relevant details set out on this website and in our brochure, will form part of your contract with the Company.
All accommodation and activity bookings made by Mud Hut Travel Ltd are subject to the following booking conditions, which are governed by English Law and under the jurisdiction of the English Courts:
1. BOOKING YOUR HOLIDAY
When you make a booking and pay a deposit, or pay in full (if you are booking within 8 weeks of departure), a contract will exist as soon as we issue you with a confirmation invoice. It is your responsibility to check this confirmation invoice, and to advise us if there are any errors or omissions. The Company will try and arrange for special requests to be met but these cannot be guaranteed. The Company will not be liable if any special request is not met. If you arrange your holiday direct with the Company all correspondence will be forwarded to the lead passenger on the confirmation invoice unless otherwise stipulated. If your booking is made through a travel agent all communications by the Company will be made to that address.
2. PAYMENTS
A deposit of the greater of £350.00 per person or 25% of the total booking amount, plus insurance premium if applicable, is payable to confirm bookings. Upon receipt of this the Company will forward a confirmation invoice. Payment of the balance is due no later than 60 days before commencement of booked packages. Please note that your accommodation, activities etc will be requested once your deposit has been received. Your confirmation invoice will indicate the cost of your requested package and you will be advised of what is still on request and unconfirmed at the time the invoice is issued. If the booking is made within 60 days of commencement, full payment is required at the time of booking.
If the holiday is made through a travel agent, all monies paid by the client to the travel agent, under or in contemplation of a contract with Mud Hut Travel Ltd are held by the travel agent as an agent of Mud Hut Travel Ltd. If payment is not received on the due date the holiday or travel arrangements will be liable to cancellation which will lead to loss of deposit. Tickets and other documents will normally be forwarded 10-14 days before date of departure.
In rare cases, certain accommodation and activities may require full payment on initial booking (even if more than 60 days prior to commencement of bookings). In these rare cases, the clients will be fully informed at time of enquiry.
3. PRICE POLICY
Prices on this website and in our brochure were calculated on the basis of known costs at the time of writing in July 2008. Individual accommodation and service prices have been calculated using the following exchange rates for £1; 2.06 US Dollars, 15.22 South African Rand, 1.32 Euros (as applicable on 31 July 2008). The price of unsold holidays may be increased or decreased at any time. The price of your holiday will be confirmed on booking. When you have booked your holiday and paid your deposit or the full amount if you book within eight weeks of departure, the price of your holiday as shown on your confirmation invoice is guaranteed and will not be subject to any changes or surcharges unless you elect to change the confirmed booking (see Clause 5). At no time is the Company liable to give a breakdown of costs due to the nature of the holiday bought by the client. Due to the financial commitments being made by the above Company we regret we are not able to make reductions in holiday prices should the GBP
strengthen.
4. CANCELLATION BY YOU
Any cancellation by the client must be advised in writing to the Company by the lead passenger. Cancellation will only come into effect on the day written advice is received by the Company. Recorded or Special Delivery is strongly recommended. Upon receipt the following charges (excluding insurance premiums and amendment charges paid) will be payable by the client, depending upon the number of days prior* to departure.

We would strongly recommend that you take out full insurance which will in most cases cover against loss of deposit or cancellation charges. Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned.
Where any cancellation reduces the number of full paying party members below the number on which the price, or any concessions agreed for your booking were based, we will recalculate these items and reinvoice you accordingly.
Where a customer has paid a deposit for the element which does not cover the cancellation fee, then the Company reserves the right to take the balance from the customer's credit card without prior notice.
*For example - if you are traveling on the 29th of October and you cancel your holiday on the 1st of October, this will be calculated as 28 days prior to departure.
#Please note that this only relates to activities booked directly through Mud Hut Travel Ltd, and not with flights or car hire where the Company has facilitated the arrangement. Refer to the relevant organisations terms of booking.
5. CHANGES MADE TO A CONFIRMED BOOKING
Where changes are possible, an administration fee plus any communication charges per alteration is applicable. Alteration of a booking within 8 weeks of departure date may incur additional costs. These costs can be quite significant, so we recommend that you do not alter your booking. PLEASE NOTE: Most flight tickets cannot be changed without payment of cancellation charges and/or the cost of a replacement ticket.
6. ALTERATION TO A CONFIRMED BOOKING WHILST ABROAD
We regret that no credit or refund is possible for any unused services provided in the cost of your holiday. If you decide to alter your travel arrangements whilst abroad this is your own responsibility and Mud Hut Travel Ltd or the Company's Agents are not responsible for any extras or difficulties that may arise with onward travel as a result of such alterations. No credit or refund is possible for any lost, mislaid, stolen or destroyed documents which could be the subject of a claim on your own insurance.
7. CANCELLATION OR ALTERATION BY US
Whilst we will take every reasonable step to avoid a cancellation or an alteration, these are sometimes unavoidable. Changing weather conditions, government regulations or changes in infrastructure may hinder transport and other services offered. In such a rare case, Mud Hut Travel Ltd reserve the right to cancel your holiday (or parts of it) at any time.
In the event of the Company having to alter, amend or cancel the holiday on or before the date when the balance of payment becomes due, you will be offered a choice of an alternative holiday of at least comparable standard if available. In some cases this may not be possible and we will need to seek your agreement to a more significant change. In an extreme case a whole trip may have to be cancelled or rebooked for alternate dates, in which event we will cover any additional administration charges, but any increase in the price of the trip or knock-on costs arising beyond the scope of our trip paperwork, such as changes to your international flights etc. will need to be covered by the group leader. If this is not acceptable, a full refund of all monies received by the Company will be due.
Circumstances amounting to "force majeure" include any event which we or the supplier of the services in question could not, even with all due care, foresee or avoid. These include, but are not limited to, war or threat of war, civil strife, riot, terrorist activity, industrial dispute, natural or nuclear disaster, fire, sickness, bad weather, the acts of any Government or public authority and all similar events which are beyond our control. It is regretted that under such circumstances there will be no compensation payable. We suggest you take out adequate insurance to cover you for these unlikely events.
8. OUR RESPONSIBILITIES
The Company applies all reasonable checks to ensure that those involved in the preparation and provision of your holiday maintain the appropriate standards. The descriptions, information and opinions on this website and in our brochure by the Company in respect of airlines, hotels and other suppliers whose services are used are given in good faith, based on the latest information at the time of printing.
However suppliers we utilise may withdraw advertised facilities (e.g. swimming pool or restaurant) for maintenance or low bookings without advising us of this. If we are advised we will try to let you know if there is time to do so before your departure. Such withdrawals of facilities are minor changes under these conditions and are not considered to materially affect your travel experience.
We do not accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised by ourselves and we have not agreed to arrange them and any excursion you purchase during your trip.
All bookings are made under the express conditions that Mud Hut Travel Ltd shall not be liable in respect of death, injury, loss or damage to person or property arising out of any act, omission or negligence of the Company, the supplier, the Company's or supplier's servants, save only in the case of willful negligence or a willful act or omission.
Mud Hut Travel Ltd shall not be liable for any damage, losses and expenses suffered by any client as a result of sickness, quarantine, weather conditions, war, strikes, riots or any other cause outside the Company's control. The Company shall in no circumstances be deemed to be the agent of the passenger or of the supplier of any service.
If sickness or accident interrupts a tour, the Company shall not be liable for any cost or expense arising there from, save only to the extent that such sickness or accident was caused by the Company's willful act or gross negligence. The Company shall not be liable for any refund, either total or partial, of passage money paid. The Company recommends passengers to take out necessary insurance's to protect the passengers against such eventuality.
Whilst staying in any accommodation, you are asked to respect the wishes of your hosts. Your hosts shall be entitled to charge you direct should any damage to their property occur whilst you are with them.
Mud Hut Travel Ltd refers you to section 14 - INSURANCE
9. RESPONSIBILITY OF THE CLIENT
Any passports, visas, health certificates, International Driving Licences and other travel documents required for the holiday must be obtained by the client, whose responsibility it remains to ensure that these are all in order and to meet any additional costs incurred (whether by the client or by the Company on the clients behalf) as a result of failure to comply with such requirements. You are responsible to arrive at stated departure times and places and any loss or damage which you suffer through failure to do so lies with you. The Company has no liability whatsoever to you through your failure to do so. The Foreign & Commonwealth Advice Unit may have issued information about your holiday destination. You are advised to check this information on BBC2 (Ceefax) page 470 onwards or on the Internet at www.fco.gov.uk.
Mud Hut Travel does not offer any advice on these matters, but may refer you to experts or other sources of information. It is the clients responsibility to check the validity and reliability of this information.
10. FLIGHTS AND AIRPORT DELAYS
The booking of flights is offered as a service to Mud Hut Travel's customers, and your contract is with the flight search engine company or airline and not with Mud Hut Travel.
For the above reason, in the unlikely event that there are lenghty delays to flight schedules, arrangements for meals, overnight accommodation, etc. should be met by your airline. Conditions of carriage are available on request when purchasing your flight.
11. CAR HIRE
Unless otherwise specified, the booking of all car hire (including 4x4 hire) is offered as a service to Mud Hut Travel's customers, and your contract is with the car rental company and not Mud Hut Travel. The Company undertakes to inform you if this is not the case.
If a hire car is reserved on your behalf, no deposit payment is required to secure this reservation. You will be required to produce your credit card and driving licence when you pick up the hire car, and all paperwork is completed then. Your credit card will be debited by the car rental company at the end of the car hire period.
12. COMPLAINTS
Most problems can be sorted out straight away if we know about them. If you have a complaint you must report it immediately and directly to the supplier (eg. Hotel Manager), or the emergency contact numbers provided with your travel documents. If you fail to follow this procedure, this may affect your rights under this contract, as we have been deprived of the opportunity to investigate and rectify the problem. If the problem cannot be resolved locally and you wish to complain, full details must be received in writing within 28 days of return.
13. SPECIAL REQUESTS
Our paperwork permits certain special requests to be entered into the contract, such as special diets. If a request is made which does not form part of our paperwork then it does not form part of the contract, regardless of what other communication may have passed outside of the trip documentation.
14. INSURANCE
We believe it is essential to take out travel insurance when you go on holiday. It is a condition of booking that you be adequately insured for the holiday. Insurance should include adequate cover for baggage, loss of money, cancellation or curtailment, personal accident, medical expenses and costs of repatriation (including international medical emergency service and air ambulance service).
Mud Hut Travel Ltd has partnered with Columbus Direct to create a bespoke travel insurance product. We advise that you utilise this service through our travel services section.
The booking of insurance is offered as a service to Mud Hut Travel's customers, and your contract is with the insurance broker and not with Mud Hut Travel.
